Welcome to the "howonearth.co.uk" website (the "website") Terms and Conditions. "howonearth.co.uk" will also be referred to as "How on Earth", "we" or "us".

Your use of this website is governed by the Terms and Conditions set out below. By using this any part of this website you agree to be bound by these Terms and Conditions.

These Terms and Conditions are governed and shall be interpreted in accordance with English Law. This does not affect your statutory rights.

Prices

 
All prices are stated in Pounds Sterling and are inclusive of VAT where applicable and are correct at the time of posting. How on Earth reserves the right to change prices without prior notice.

A delivery charge will be added to your order where appropriate. Details of charges can be found in the "Delivery" section of the website. Whilst How on Earth will make every effort to deliver goods as quickly as possible, any times or dates stated are only estimates. We do not accept liability for any delay or subsequent consequences.

All orders are subject to acceptance and to availability. How on Earth is entitled to refuse any order placed by a customer. We also retain the right to rescind the contract if a manifest error or omission is found after the order has been accepted and / or payment has been received.

Passing of Property

 
Ownership of goods shall not be passed to the customer until How on Earth has received full payment and the funds have been cleared. Until such time as an order has been despatched, the customer has the right to cancel the order and require any monies paid to How on Earth to be refunded. Any request to cancel an order should be made to us in writing.

Passing of risk

 
Delivery is deemed to take place when the goods are delivered to the customer’s nominated address, whereupon the risk of loss, breakage, damage and all other risks shall pass to the customer.

Where the goods are signed for, the customer bears the risk once the goods are signed for. If a customer believes that a parcel has been damaged in transit, it is their responsibility to refuse to sign for the goods.

Acceptance
 
The customer should inspect the goods upon receipt and notify us in writing within 3 days of any errors or damages. If no notification is made to us within this period, the customer shall be deemed to have accepted the goods. How on Earth will not accept liabilities for errors or damages notified after this time.

If for any reason we are unable to supply the goods ordered How on Earth may offer alternatives of equal or higher value at no additional cost. The customer is under no obligation to accept the offered alternative and may cancel the order if they wish. If they do so, any monies already paid for the goods shall be refunded in full.

If the customer cannot accept delivery, How on Earth will attempt to re-arrange delivery if requested by the customer. In this case, we reserve the right to charge the customer any additional delivery costs incurred.

Returns
 
In the case of errors or damages, the customer should notify us within 3 days of receipt. The customer will then be entitled to a full refund or replacement. Please note, the goods must be returned to us in their original packaging before we can issue a refund or replacement. Please ensure the goods are returned within 7 days of receipt.

In the case of an incorrect order or dissatisfaction, the items should be returned to us within 7 days of receipt for a full refund or replacement. Please include details of the return including your name, order number, the products that you are returning and whether you would like an exchange or refund.

Please note that, except in the case of faulty goods, postage costs will not be refunded and where the customer took advantage of a free postage offer, the standard posting charge shall still be deducted from any refund. We recommend that proof of posting is obtained in order to ensure the items reach us safely. We cannot be held responsible for items mislaid before reaching our premises.

Please return all the goods in their original condition and packaging. Toiletries should remain sealed.

Payment
 
Payment can be made by cheque, any major credit or debit card including Maestro, Solo, Visa, Visa Electron, Mastercard or American Express or using a PayPal account. Online payments are made via an intermediate secure website and funds will be debited before any goods are dispatched.

By making a purchase, you undertake that the details you provide are correct and that you are authorised to use the card. Also, you guarantee that there are sufficient funds or credit facilities to cover the value of the purchase. We reserve the right to request validation and authorisation from the credit or debit card issuer and we may share your personal information with these parties in order to carry out these checks. If the issuer refuses payment, we will not be liable for any delay.

Any person attempting to make fraudulent credit card transactions will be prosecuted.

Howonearth.co.uk provides links to other sites which it believes may be useful or of interest to its customers. We cannot accept liability or responsibility in respect of these websites. We have no control over their content or usage and the placement of the links on our website does not constitute an endorsement or affiliation with How on Earth.

Accuracy
 
How on Earth makes every effort to ensure product images, descriptions and details are accurate. However, the customer should be aware that slight variations may occur. Please note that packaging may vary from that shown.

Whilst we do our best to ensure that any information provided on our website is correct and up to date, we do not give any warranty as to its accuracy or completeness nor we do not accept liability or responsibility for any consequences arising from the use of the information.

Please note that this also applies to our ingredients and ‘free from’ lists which are correct to the best of our knowledge at the time of posting, but due to reliance on our suppliers for the information, we cannot give any warranty to their accuracy or completeness. If you are in any doubt about a product or its ingredients, please contact the manufacturer for more information.

Liability
 
Whilst we do our best to provide an efficient and reliable service, we do not guarantee that your use of this website will be interruption or error free. We cannot accept any liability or responsibility for any disruption or technical issues you experience.

We will not accept responsibility for any disruption, loss of or corruption of any material in transit, or loss of or corruption of material or data when downloaded onto any computer system.

The entire liability of How on Earth under or in connection with any contract for any products to which these conditions apply shall not exceed the price of the products, except as expressly provided in these conditions.

Your statutory rights
 
Under the distance selling regulations, you have the right to cancel your purchase within 7 working days of receiving the goods. If you wish to cancel your order, you must notify How on Earth in writing within this 7 day period. The customer is advised that they are under obligation to remain in possession of the goods until they are returned to us and to take reasonable care of the goods whilst in their possession. As such, unwanted goods should be returned unused, unopened and in a re-saleable condition.

The customer must pay the cost of returning the items to How on Earth, and it is recommended that proof of posting is obtained to ensure the goods are received by us.

All monies due to the customer will be refunded by the original means of payment within 30 days. Please note that the cost of any specifically requested services such as gift-wrapping or express delivery will be deducted from any refund made to you, as stated at the time of ordering these services.

The offer is available to all existing How on Earth customers who comply with the following conditions:
1. They must have previously made a purchase from How on Earth.
2. This offer cannot be used in conjunction with any other offer.
3. New customers must place an order to the value of £20 or over (plus postage where applicable) with How on Earth between 01/05/08 and 31/05/08.
4. The offer only applies if the new customer does not cancel or return the items ordered.
5. There is no alternative to the £5 How on Earth Gift Vouchers and they are non transferrable.
6. There is no cash equivalent. Redeemable value of gift voucher is 0.01p.
7. To qualify as a new customer, the person must not have previously contacted How on Earth or be registered on our mailing list.
8. How on Earth reserves the right to withdraw the offer at any time.
9. How on Earth reserves the right to refuse a customer at our discretion.
